That's right: Once your documents are stored with us, they qualify as originals, by both state and Federal rules. You can even ask us for a certified original of one of your files, and we'll put a stamp on it guaranteeing that it hasn't been tampered with since the day it arrived on our system.

Some of our customers were curious about the specifics of how a document scanned into our system can be a "legal original" -- The answer involves some very high-end technology, but the legal side is explained in the box below.

  3. Optical Imaging Act (“OIA”)
  4. Health Care Insurance Portability and Accountability Act (“HIPAA”)
  5. SANS / FBI Top 20 Security and Network Security Vulnerabilities

A digital image is admissible (i.e.: replaces the paper original) if three things happen:

  1. The digital image is accurate (could not have been modified, even by the persons who own the information);
  2. The digital image is accessible to those entitled to access it: and,
  3. The digital image is capable of being reproduced at a later time.

Krypton meets all of these requirements once the image is in Krypton’s possession.

The three part test referenced above is based on several Federal and State Statutes. The two most significant Acts are the Uniform Electronic Transaction Act (“UETA”) and the Electronic Signatures in Global and National Commerce Act (“E-SIGN). UETA is a uniform set of laws which have been adopted, as written by a majority of States. All but five States have adopted some form of UETA. Those States which have not adopted UETA are governed by E-SIGN.
